Southeastern Pipe Line Co. v. Tichacek

In Southeastern Pipe Line Co. v. Tichacek, the Court held a jury charge to be defective and remanded the case. 997 S.W.2d 166, 172 (Tex. 1999). The Court noted that one kind of defective question "plainly attempts to request a finding on a recognized cause of action, but does so improperly." Id. (citing Spencer, 876 S.W.2d at 157). And in Tichacek, the party benefitting from the erroneous charge had not chosen to abandon its claim, but had "simply requested an improper submission of the issue to the jury." Id.
