State ex. rel. Holmes v. Third Court of Appeals

In State ex. rel. Holmes v. Third Court of Appeals, 885 S.W.2d 389, 397 (Tex. Crim. App. 1994), the Court accepted the proposition that the execution of an innocent person would constitute a violation of the Due Process Clause of the Fourteenth Amendment to the United States Constitution. Accordingly, the Court held that a post-conviction application for a writ of habeas corpus was an appropriate vehicle for a convicted defendant sentenced to death to assert a claim of actual innocence. Id. at 398.
