In Vodochodsky v. State, No. 74,129, (Tex. Crim. App. 2004), the Texas Court of Criminal Appeals reversed a conviction for the murder of a police officer by a friend of the appellant where there was no evidence the appellant had acted with the intent to promote or assist in the murder despite his knowledge of his friend's plan to commit the murder.
