Conversion is the unauthorized and wrongful assumption and exercise of dominion and control over the property of another, to the exclusion of or inconsistent with the owner's rights. Rogers v. Ricane Enters., Inc., 930 S.W.2d 157, 165 (Tex. App.-Amarillo 1996, writ denied). Generally, a claim for conversion begins to run at the time of the unlawful taking. However, if the original possession is not unlawful, the limitations period does not begin to run until the return of the property has been demanded and refused, or until the person in possession has unequivocally exercised dominion over the property inconsistent with the claims of the owner or the person entitled to possession.
