Woolsey v. Panhandle Ref. Co

In Woolsey v. Panhandle Ref. Co., 131 Tex. 449, 116 S.W.2d 675, 678 (Tex. 1938), the Court held as unenforceable a contract in which a subscribing employer promised an injured employee lifetime employment in exchange for his agreement not to file a workers' compensation claim. 116 S.W.2d at 678. The Court recognized that refusing to enforce the agreement may injure the plaintiff employee, but this result would be "far less disastrous to the great army of employees operating under this statute than to hold that under the law an employee and an employer can contract away the rights of the employee." Woolsey, 116 S.W.2d at 678.
