Reichl v. State Farm Mut. Automobile Insurance Co

In Reichl v. State Farm Mut. Automobile Insurance Co., 75 Wn. App. 452, 880 P.2d 558 (1994), the plaintiff sought damages from her insurance company for delay in payment of her medical bills. The Court of Appeals concluded there that delay damages were not justified under the evidence because the plaintiff had failed to timely provide additional proof or information sought by the insurer before fully settling her claims against the tortfeasor. In other words, because the plaintiff in Reichl was partially at fault for any delay in processing the claims, damages were not available to her.
