State ex rel. Galbraith v. Superior Court

In State ex rel. Galbraith v. Superior Court, 59 Wash. 621, 110 P. 429 (1910) the Court reviewed a decision granting a right of way for an irrigation canal. Galbraith, 59 Wash. at 623. Significantly, the Court found: "These lands, without irrigation, will produce no crops of value and are of little value, but with irrigation will produce large and valuable crops of vegetables, grain, hay, fruits, and other agricultural products." Id. at 625. Because the other potential sources of water were impractical and expensive, we allowed condemnation to irrigate the land. Id. at 633-34.
