Pinkston v. General Tire & Rubber Co

In Pinkston v. General Tire & Rubber Co., 30 Ark. App. 46, 782 S.W.2d 375 (1990), the Court affirmed that part of the Commission's decision holding awarding additional medical benefits to a man who suffered a compensable back injury in July 1982 but who testified that his back "went out" while he was drying off after getting out of his bathtub in January 1986. The Commission deemed the subsequent incident a recurrence, meaning a continuation of the first compensable injury.
