Eureka Teacher's Assn. v. Board of Education

In Eureka Teacher's Assn. v. Board of Education (1988) 202 Cal. App. 3d 469, the teacher's association sought mandamus ordering the Board to employ a teacher returning from maternity leave and to give that teacher retroactive probationary status, although the teacher was formally classified as a substitute. The teacher's association also sought back pay and fringe benefits for the teacher. Partially in reliance on Snipes, the Court of Appeal held that the request for money damages was incidental to the mandamus action, and that the claim was not one for money or damages under the Tort Claims Act.
