Hunsucker v. Sunnyvale Hilton Inn

In Hunsucker v. Sunnyvale Hilton Inn (1994) 23 Cal.App.4th 1498, the plaintiffs contended the trial court erred in holding the acts of a hotel in reporting to the police that plaintiffs had a gun was absolutely privileged under Civil Code section 47, subdivision (b). There, a police report by a hotel manager to the local police was the basis of plaintiffs' causes of action for assault, battery and falsely imprisonment. (Hunsucker, supra, at p. 1502.) Hunsucker affirmed a summary judgment in favor of the defendant hotel, holding "reports made by citizens to police regarding potential criminal activity fall within the section 47 absolute privilege." (Hunsucker, supra, at p. 1503)
