People ex rel. Busch v. Projection Room Theater

In People ex rel. Busch v. Projection Room Theater (1976) 17 Cal.3d 42, the district attorney brought an action seeking to restrain the exhibition of obscene books and films, using the public nuisance laws, including the Red Light Abatement Law. The California Supreme Court held that the Red Light Abatement Law was not intended to apply to the exhibition of obscene materials, and that although a court could properly enjoin exhibition of materials which have been adjudged obscene, exhibition of such materials does not permit an abatement action against the premises.
