In Valeo v. Tabish, 295 Mont. 34, 983 P.2d 334 (1999), the Court stated there is no unilateral statutory right to attorney's fees analogous to the express right to recover pursuant to a contract or other obligation under Section 28-3-704, MCA. Id. at 34, 983 P.2d at 338. As there was no contract between the parties, the Court found Section 28-3-704 inapplicable. Id. at 40, 983 P.2d at 338.
