City of El Paso v. W.E.B. Investments

In City of El Paso v. W.E.B. Investments, 950 S.W.2d 166 (Tex.App.--El Paso 1997, pet. denied), the City of El Paso's street operations supervisor mistakenly ordered a third party's motor-driven equipment to demolish a condemned building before the time had expired for repairs to be made. The Court found sovereign immunity was waived even though a governmental employee did not personally operate the motor-driven equipment. Id. at 170.
