In Giant Food Inc. v. FTC, 116 U.S. App. D.C. 227, 322 F.2d 977, 986 (D.C. Cir. 1963), an ambiguous disclaimer was found to "only add to the deceptiveness" of an ad. Id. at 986.
The advertisement compared Giant's prices to misleadingly high "suggested list prices," and the disclaimer implied that the "list prices" were prices charged by competitors. Id.
In fact, however, competitors' actual prices were significantly lower than the "list prices." Id.
