Carson v. City of Prichard

In Carson v. City of Prichard, 709 So. 2d 1199 (Ala. 1998) the homeowners presented substantial evidence indicating that, as a result of the defendant's negligent operation and maintenance of the sewer system, they "suffered, and continued to suffer, from the overflow of raw sewage into their yards and homes after periods of heavy rain." 709 So. 2d at 1202. "According to the plaintiffs, the odor from the sewage overflow was so great that they could not eat in their homes and were embarrassed to have visitors." Id.
