Oswald v. State

In Oswald v. State, 715 P.2d 276, 280 (Alaska App. 1986) the defendant digitally penetrated the victim's vagina and subsequently engaged in forced vaginal intercourse. The state conceded that the act of digital penetration was an initial step leading to the act of vaginal intercourse, and therefore could not support a separate conviction. The Court accepted the state's concession that only one conviction and sentence was appropriate.
