City of Phoenix v. Superior Court In & For County of Maricopa

In City of Phoenix v. Superior Court In & For County of Maricopa, 184 Ariz. 435, 909 P.2d 502 (App. 1995), an unsuccessful bidder for a city construction project relied on A.R.S. 32-1151 to unseat, by special action to the superior court, the successful bidder. Id. The Court recognized that while 32-1151 required a bidder on a construction contract to have "all licenses required for the entire project at the time it submits a bid," following Aesthetic Property Maintenance, we held that the successful bidder, who had a license, substantially complied with the statute by getting the additional required licenses after the Registrar of Contractors opined that other licenses were required. See City of Phoenix, 184 Ariz. at 437-38, 909 P.2d at 504-05. As a result, the Court granted the successful bidder relief by vacating the superior court's order. Id. at 438, 909 P.2d at 505.
