California Government Code 12900 - Example Case

In Rojo v. Kliger, the California Supreme Court considered the preemptive effect of the California Fair Employment and Housing Act (FEHA) (Gov. Code, 12900 et seq.) on nonstatutory employment discrimination claims. The court found the statutory language was clear and unambiguous regarding preemption, because FEHA expressly disclaimed any intent to repeal other state laws relating to discrimination. (Rojo v. Kliger, supra, at p. 73.)
