Estate of Britel

In Estate of Britel (2015) 236 Cal.App.4th 127, the court was tasked with deciding whether the mother had established by clear and convincing evidence the father openly held the child as his own. (Id. at p. 136.) The court determined substantial evidence supported the trial court's finding that mother had not met her burden because the father never openly acknowledged paternity to his family or friends. Instead, he told the mother to stop contacting him. (Id. at p. 138.) Britel does not address the question of whether uncorroborated testimony from the mother about paternity constitutes substantial evidence, even under a clear and convincing standard of proof.
