Gruzen v. Henry

In Gruzen v. Henry (1978) 84 Cal. App. 3d 515, the plaintiff landlord had not secured a certificate of occupancy required by an ordinance of the City of Pasadena to insure that properties met health and safety requirements of the city's code. (Id., at p. 517.) In an unlawful detainer proceeding, the Court of Appeal held the rental agreement void and denied a money judgment to the landlord for rent due. (Id., at pp. 517, 519.) The court concluded that the proper remedy in the case was eviction, not rent. (Id., at p. 519.)
