In In re Marriage of Terry (2000) 80 Cal.App.4th 921, the supported spouse enjoyed "an investment portfolio of nearly $ 3.75 million, retirement benefits approaching $ 1 million and real estate valued at $ 773,500." (80 Cal.App.4th at p. 924.) Mrs. Terry's investment portfolio included a family inheritance of over $ 300,000 and a $ 200,000 promissory note payable to her. ( Id. at pp. 934-935, fns. 2, 4, dis. opn. of Sepulveda, J.) Further, Mrs. Terry owned her $ 773,500 home free and clear. (Id. at p. 931.) Because Mrs. Terry had millions of dollars in investments and real property, the appellate court found that the trial court should have terminated spousal support and required Mrs. Terry to live on her separate estate. ( Id. at pp. 931-932.)
