Motion to Reopen Criminal Case in California

In People v. Green (1980) 27 Cal.3d 1, the trial court denied the defendant's motion to reopen on the ground that it had no authority to reopen the case after deliberations had begun. On appeal, this was held to be error, in that a trial court has authority to order a case reopened for good cause even after jury deliberations have begun. (Id. at p. 42.) Because the trial court believed it lacked the authority to exercise its discretion to reopen the case, it erred by failing to exercise its discretion. (Ibid.)
