People v. Kramis

In People v. Kramis (2012) 209 Cal.App.4th 346, the court examined the same argument as raised here by Estrada. The court rejected the contention that the discretionary process under section 1202.4, subdivision (d) in setting the amount of the fine within the statutory maximum constituted judicial factfinding that improperly increased punishment beyond the statutory maximum for the offenses for which the defendant was convicted.
