People v. Malfavon

In People v. Malfavon (2002) 102 Cal.App.4th 727, the court held that substantial evidence supported the jury's finding that the defendant had care or custody of the child when the defendant admitted he was responsible for watching the child, who was asleep in a car seat, while the child's mother went upstairs to the defendant's apartment, and other evidence showed that the defendant had been the child's babysitter in the past. (People v. Malfavon, supra, 102 Cal.App.4th at p. 737.)
