People v. Martin (1983)

In People v. Martin (1983) 150 Cal.App.3d 148, the defense argued there was insufficient evidence to establish conspiracy to commit extortion and conspiracy to commit assault with a deadly weapon. After getting into a dispute with the deceased victim, the defendant had directed the boyfriend of his employee to beat up the victim and to collect money. The boyfriend ended up killing the victim and testified at trial that the defendant solicited him to assault the victim and threatened the loss of a job as leverage. Citing People v. Lipinski (1976), the court held there was sufficient evidence to support both counts of conspiracy.
