Woolls v. Superior Court

In Woolls v. Superior Court (2005) 127 Cal.App.4th 197, the petitioner sought to enforce an arbitration agreement that failed to comply with the disclosure requirements mandated in Business and Professions Code section 7191. (Woolls, supra, 127 Cal.App.4th at p. 200.) He argued that the statutory provision was preempted by the FAA, but submitted no declarations to show the transaction at issue involved interstate commerce. (127 Cal.App.4th at p. 213.) The court found the petitioner had failed to present a factual record establishing preemption. (Ibid.)
