Champion v. People

In Champion v. People, 124 Colo. 253, 236 P.2d 127, 130 (Colo 1951), the defendant produced persuasive evidence that the State would have been unable to prove the elements of the crime charged had his case proceeded to trial. 236 P.2d at 130. Furthermore, the prosecutor in that case conceded that evidence received after defendant's guilty plea would not have sufficed to garner a conviction on the crime charged. Id.
