J & S Enterprises v. Continental Casualty Co

In J & S Enterprises v. Continental Casualty Co., 825 P.2d 1020 (Colo. App. 1991), business owners at a mall suffered losses when the mall was closed because of the release of asbestos, and the owners sought coverage from their insurer. The trial court determined that the policy excluded coverage for such contamination. On appeal, a division of this court agreed, after determining that the two exemption clauses were entirely independent and should not be construed together.
