In People v. Garcia, 940 P.2d 357 (Colo. 1997), the supreme court permitted such a request because the charging document there adequately notified the defendant of the prosecution's proposed lesser non-included offense charge. Thus, the court concluded that the instruction on the lesser non-included offense did not violate the defendant's right to due process.
