State v. Moldovan

In State v. Moldovan, 842 P.2d 220 (Colo. 1992), the plaintiff collided with a cow that had wandered onto the highway through an inadequately maintained fence constructed by the state at the right-of-way boundary. The court discussed the open-range law which requires landowners to fence livestock out, not in, as imposing a duty. The fence in Moldovan was a safety device installed by the state and not adequately maintained.
