Swieckowski v. City of Fort Collins

In Swieckowski v. City of Fort Collins, 934 P.2d 1380 (Colo. 1997), the Court held that the word "maintain," as it appears in 24-10-103(1), means to repair or restore a roadway to the same condition as originally constructed. The Court held that a public entity was immune from liability for injuries plaintiff sustained when a road improvement suddenly ended, because the hazard was not the result of a negligent act or omission by the city in maintaining the roadways, but rather was a result of inadequate design.
