In Thurman v. State Farm, 942 P.2d 1327 (Colo. App. 1997), the Court held the trial court erred in ordering an insurer to pay its insured attorney fees expended by the insured in obtaining a settlement from the underinsured tortfeasor. This is because the insured would have had no right to recover such fees against the uninsured tortfeasor.
