In Daly v. DelPonte, 225 Conn. 499, 515, 624 A.2d 876 (1993), the Court established the requirement of strict scrutiny review for an equal protection claim that is based on disability. Id., 513-14. In Daly, however, it was undisputed that the state action to which the plaintiff objected was based on the plaintiff's disability. Id., 512.
