Portnoy v. King

In Portnoy v. King, Superior Court, judicial district of Stamford-Norwalk, Docket No. 087873 (Nov. 6, 1990), the court granted the defendant's motion for summary judgment as to that count of the complaint alleging common-law liability for a dog bite to which the defendant claimed governmental immunity as a defense. The issue in that case focused on whether a decision that a dog is dangerous and should be destroyed is characterized properly as a discretionary decision and, thus, protected by governmental immunity.
