In State v. Hartford Accident & Indemnity Co., 136 Conn. 157, 70 A.2d 109 (1949), the state brought the action, but the defendant was authorized by special statute to pursue its counterclaim. The court noted, in dictum, that the authorization was not necessary because the state had brought the action. Id.
