State v. Myers

In State v. Myers, 242 Conn. 125, 139 n.17, 698 A.2d 823 (1997), the defendant filed a motion for a new trial pursuant to Practice Book 902, now 42-53. The state argued that "the defendant's claim of juror bias was initiated through a procedurally defective petition for a new trial." State v. Myers, supra, 242 Conn. at 134. The Court noted that the motion "clearly did not meet the requirements of a petition for a new trial because it too was filed within the confines of the criminal case." Id. at 135. The court further held that "the issue of juror bias was properly before the trial court in the motion for a new trial brought prior to judgment and pursuant to Practice Book 902 now 42-53." State v. Myers, supra, 242 Conn. at 139.
