Not Identical Parties on Appeal

In this civil appeal from the Justice of the Peace Court an appeal was dismissed because it was not filed within fifteen days from the entry of judgment in the court below. Additionally, the appeal was dismissed because the parties on appeal were not identical with the parties that were sued in the Justice of the Peace Court. The appeal violates the mirror image rule. the parties on appeal must be identical with the parties sued in the original action. Cooper's Home Furnishings v. Smith, Del. Super., 250 A.2d 507 (1969). For the foregoing reasons the above captioned appeal was dismissed.
