In Petrucelli v. McFarland, Del.Super., 1989 WL 41700, Taylor, J. (March 20, 1989), the notice from the Court stated that the last date of appeal was April 6, 1988, whereas the appeal should have been filed on or before April 4, 1988. The appeal was filed one date late on April 5, 1988. Judge Taylor held in Petrucelli that since the notice stated a specific date for filing an appeal a pro se litigant should not be expected to second guess the court's notice. Id. at 2.
