In State v. Burris, 2010 WL 2195967, (Del. Com. Pl.) the Court of Common Pleas found that it was reasonable and necessary to transport a defendant from the scene of a motor vehicle accident as part of an investigatory detention to conduct field tests because there was no shoulder on the roadway near the scene, it was raining, and only the investigating officer was present.
