State v. Hamilton

In State v. Hamilton, 1987 WL 9602 (Del. Super. Ct. Apr. 8, 1987) the Superior Court upheld a Court of Common Pleas finding that there was "ample evidence on the record from which to draw the logical and reasonable inference that the crime occurred in Sussex County." In Hamilton, the defendant was charged with misdemeanor theft of an ohm meter and a set of keys. The court found that the defendant lived and worked in Sussex County and received the keys and meter from a location in Sussex County. Id. Additionally, the keys were to a house in Sussex County. Id. Finally, "there was no hint in the record that the events took place anywhere other than in Sussex County." Id. Therefore, when taken as a whole, the court found that the evidence was sufficient to prove jurisdiction and venue. Id.
