Wilmington & N. R. Co. v. Delaware Valley Ry. Co
In Wilmington & N. R. Co. v. Delaware Valley Ry. Co., 1999 WL 463705, (Del. Super. Mar. 30, 1999) the Delaware Superior Court found that the guarantee provision did not extend to rental payments after the lease concluded because the tenant expressly terminated the lease.
However, the Court recognized that the case before it was "not a case were the landlord and tenant simply neglected to renew a lease at the end of its term, a situation that may, by operation of law, extend or renew the original lease. "
