Carpenter v. State (2001)

In Carpenter v. State, 785 So. 2d 1182 (Fla. 2001), the Court concluded that the trial court erred when it questioned the credibility of in-court witnesses. The Court explained that under Florida law, the credibility of an in-court witness who is testifying as to an out-of-court declaration against penal interest is not a matter for the trial court's consideration in determining whether to admit the testimony. 785 So. 2d at 1203. Instead, the jury has the duty to assess the credibility of an in-court witness who is testifying about the out-of-court statement against penal interest. Id.
