Does the Freedom of Choice Concerning Abortion Extends to Minors ?
In In re T.W., the Court said:
"The Florida Constitution embodies the principle that 'few decisions are more personal and intimate, more properly private, or more basic to individual dignity and autonomy, than a woman's decision . . . whether to end her pregnancy. a woman's right to make that choice freely is fundamental." In re T.W., 551 So. 2d at 1193.
This Court continued:
"The next question to be addressed is whether this freedom of choice concerning abortion extends to minors. the court concluded that it does, based on the unambiguous language of the amendment:
The right of privacy extends to 'every natural person.' " In re T.W., 551 So. 2d at 1193.
In In re T.W. this Court explicitly identified legislative inconsistency as an obstacle to the enactment of the legislation at issue.
