Tim's Crane and Rigging Inc. v. Gibson

In Tim's Crane and Rigging Inc. v. Gibson, 278 Ga. 796, 604 S.E.2d 763 (Ga. 2004), the court held that because the contract of hire between the special and general employer "explicitly set forth each requirement of the borrowed servant doctrine," it established that the general employee "was a borrowed servant as a matter of law." Id. at 765. The court found the contract to be controlling as to the parties' respective responsibilities. Id.
