Wynn v. Ibold, Inc

In Wynn v. Ibold, Inc., Ky. 969 S.W.2d 695 (1998), the Supreme Court upheld the tier-down statute despite an equal protection/due process challenge and reasoned that "a reduction in workers' compensation benefits upon a worker's eligibility for an alternative form of income replacement is consistent with the principle of coordinating the various systems of wage-loss protection in order to avoid a duplication of benefits." (Id. at 696.)
