Baker v. Thibodaux

In Baker v. Thibodaux, 470 So. 2d 245 (La. Ct. App. 1985), a golfer brought an action against the golf club and another golfer for injuries sustained when he was struck in the eye by a golf ball. The court observed that the plaintiff, who was playing the 15th hole at the time of the accident, had actual knowledge the defendant was ahead of him on the 16th tee. Id. at 249. The court noted: "The risk of being struck by an errant shot hit by a player on a contiguous or adjacent fairway is 'a risk all golfers must accept.'" Id.
