Wall v. Progressive Barge Line, Inc

In Wall v. Progressive Barge Line, Inc., 703 So.2d 681 (La. Ct. App. 1997), the Court of Appeals of Louisiana considered the claim of the survivors of a boat captain (Captain Wall) who fell between two barges moored together in a river. The Wall Court upheld a $ 50,000.00 award for the deceased's pain and suffering prior to death based on the fact that when the decedent's body was recovered there was no evidence of physical injury to the body, except for asphyxiation.
