Electronic Media Int'l v. Pioneer Communications of Am., Inc

In Electronic Media Int'l v. Pioneer Communications of Am., Inc., 586 A.2d 1256, 1259 (Me. 1991), the Law Court applied this "contract-plus" analysis to determine whether the plaintiff had carried its burden on the second prong of the due process test. In that case, the plaintiff alleged that the defendant entered into a $ 3,000 contract with the plaintiff, engaged in discussions and negotiations with the plaintiff over a period of five months, sold and delivered products to the plaintiff, made assurances to the plaintiff that the defendant would perform under the contract, and knew or should have known that the plaintiff was relying to its detriment upon the defendant's price quotations. Id. at 1260. The Law Court concluded that those allegations compelled the conclusion that the defendant reasonably should have anticipated litigation in Maine. Id.
