Owen v. Kessler

In Owen v. Kessler, 56 Mass. App. Ct. 466, 778 N.E.2d 953 (2002) the Appeals Court stated, "Under Massachusetts law . . . . the deadline is a condition subsequent, and if the condition subsequent is not met, or waived, then the parties' obligations to each other are extinguished." 56 Mass. App. Ct. at 469.
