Story v. City of Bozeman

In Story v. City of Bozeman (1990), 242 Mont. 436, 450, 791 P.2d 767, the Montana Supreme Court commented that in the majority of ordinary contracts, a breach of the covenant of good faith and fair dealing is only a breach of the contract and only contract damages, not tort-type damages, are due. Thus, the tort of bad faith exists only in exceptional circumstances which have either been specified by statute or pertain to contracts involving special relationships. Story, 242 Mont. at 451.
